AN ALLOA man who was arrested twice in the space of four months for selling heroin has been ordered to undergo drug treatment by a sheriff.
Thomas Speirs was detained in October last year with around £200 worth of the Class A drug, along with a similar amount in cash, and prosecuted for possession with intent to supply.
The 37-year-old was then arrested last February when officers raided his home on Shaftesbury Street, finding almost £1,000 worth of heroin in his home.
At Alloa Sheriff Court on Thursday, (29 October) Speirs admitted both drug offences, along with a separate charge of threatening to stab a police officer in June.
Just over a year ago, On October 10, 2014, he was found in possession of diamorphine with intent to distribute.
A not guilty charge to being in possession of diazepam with intent to supply was accepted by the Crown.
A few months later, on 17 February, police raided his home and more heroin was uncovered.
Depute fiscal Eilidh Robertson told the court: “Officers executed a search warrant at the address and the accused was within the property at the time.
"They seized a number of items times consistent with the accused being concerned in the supply of controlled drugs.
“A quantity of diamorphine was seized with an estimated street value of around £970."
In reply to caution and charge, the accused replied: "Not guilty.”
On June 18, Speirs was lifted again following an altercation with police at his home.
Ms Robertson said: “At 4am, police attended the locus following reports of excessive noise. They knocked on the front door, however, the accused met them with abusive language."
Spiers told them: "F**k you, ya b******s" and taunted them by saying: "Try come through my f***ing door".
While travelling to Stirling Police Station, the accused said to officers: "I’ll f***ing stab you" and "I’ll f***ing burst you”.
In sentencing, Sheriff David Mackie gave Speirs a chance to remain within the community, providing he comply with court-ordered treatment.
He said: “In respect of all these matters, I will follow the recommendations of the report and impose a community payback order.
“I have to warn you, if you don’t engage with this, it will simply bring you back to court and a different sentence may be considered.”
Speirs was given a drug treatment requirement and placed under supervision for the next two years.
