TWO pals who threatened to stab each other were lucky to avoid jail last week.

On Thursday (January 7) at Alloa Sheriff Court, Edward McIntyre admitted assaulting Konrad Langer by kicking him on the body at his home address in Clackmannan’s Backwood Court on December 6, 2015.

At the same time, Langer also pleaded guilty to shouting, acting in an aggressive manner and uttering threats of violence during the same incident. 

Fiscal depute Ann Orr told the court that the police received a call from McIntyre stating that Langer was in his flat and he wanted him removed.

McIntyre, 31, threatened that if they didn’t come, he would “stab” Langer.
Officers attended and heard a disturbance.

On seeing the police, McIntyre claimed Langer had assaulted him. At this point Langer was on the floor, to which McIntyre kicked him on the body.

As McIntyre was restrained, Langer shouted: “I’ll f**king stab you.”

Both men, who each had facial injuries, were thereafter arrested.

Defence agent Gary Munro claimed that Langer, 45, had a record, but had not offended between 2009 and 2015 and was instead well on his way to becoming completely drug free.

Mr Munro stated that a third male instigated the fight, but there was no “bad blood” between the men.

Defending McIntyre, Kelly Howe said her client was remorseful of his actions towards Langer and was himself a vulnerable person with mental health issues.

Sheriff Christopher Shead sentenced Langer to a Community Payback Order with supervision for 12 months with 50 hours of unpaid work to be completed within six months.

McIntyre was also sentenced to a CPO with 70 hours unpaid work to be completed in six months.
