A father who smacked a younger man in the face because he posted online that his son was dead was spared jail on Wednesday.

John Binnie, 50, stormed round to Fraser Anderson's house in Cornton, Stirling, after Mr Anderson, 20, posted a photo on social media of Binnie's son Jordan.

Jordan, also 20, was pictured "in a recumbent position", on his back, with his eyes shut, apparently after a night out.

Mr Anderson captioned the image, "dead".

Stirling Sheriff Court was told that Binnie "attended at" Mr Anderson's house uninvited, marched inside, and punched him twice in the face after the posting on June 28 last year.

Mr Anderson fell to the ground with a bleeding nose.

Binnie, also of Cornton, Stirlingshire, pleaded guilty to assaulting and injuring Mr Anderson in his home - the ancient Scots law offence of hamesucken.

Defence solicitor Gordon Murphy told the court: "He went round to the house of a friend of one of his son's friends to see about this photo that was posted on social media stating his son was dead when he wasn't."

Sheriff Wyllie Robertson spared Binnie jail but fined him £600.

He told him: "This was not acceptable behaviour, notwithstanding what I have heard of the background - to go round to someone's house, march inside, and assault them is a serious matter.

"You cannot take the law into your own hands."
