A MAN kicked off after his partner confronted him about texting another girl.

Fiscal depute Matthew Kerr told Alloa Sheriff Court last Wednesday that Daniel Morgan and his girlfriend had been in a relationship for around two years at the time of the incident on February 2, 2017.

It was around 2pm when the complainer returned home to Craigleith Terrace in Alva after visiting family. Whilst her son slept in his pram in the hallway, she followed Morgan into the bedroom as she could tell he was upset.

After asking him what was wrong, she then accused him of messaging another girl. The complainer told Morgan she was able to tell from his phone account how many times he'd been texting someone else.

An argument arose, spilling into the living room. During the 29-year-old accused's temper tantrum, he shouted, swore, grabbed his partner's phone and launched it against the couch.

When the complainer started to cry, the accused took refuge in the bathroom before returning once more to the living room.

He approached the complainer, who was sitting on the couch, grabbed her face with both hands and said "listen to me" in a "sinister and frightening" voice. The complainer was able to push him away with her feet.

Morgan then went for a bath. During his soak, he called the complainer into the bathroom to apologise for his actions.

The authorities were later notified by the complainer's mother. During his interview with police, the accused made partial admissions.

Representing himself, Morgan pleaded guilty to acting in a menacing manner as well as the assault.

He did not disagree with the narrative, telling the court: ""What [the Crown] said, that's what happened."

Sheriff David Mackie deferred sentence until May 4 for the completion of a Criminal Justice Social Work report.

Sheriff Mackie advised the accused, of Craigbank in Sauchie, to seek legal advice given his history of domestic assault.

He warned Morgan: "This is quite serious."
