A WOMAN who phoned police to say she was going to kill her husband has been given a community payback order (CPO).

Alloa Sheriff Court was told last Thursday that Rosemary Malloy pleaded guilty earlier in May when she appeared from custody.

Malloy phoned police on April 24 at around 6pm and claimed that she was going to murder her partner with whom she had been drinking with prior to the call.

While police were en route to her address on Walker Terrace, Tillicoultry, they received another call to say that she had a knife.

When the police arrived at the locus, they found Malloy there heavily intoxicated before she showed officers a knife lying on the floor.

Susannah Hutchison, prosecuting, told the court that officers heard Malloy say: “I am going to stab him”.

She then continued to make threats towards her husband and also some which concerned harming herself.

When she arrived at the police station after being arrested, she became “very apologetic”, according to Ms Hutchison.

Jim Savage, representing the 50-year-old, told the court that his client suffered from “longstanding issues with alcohol and mental health difficulties”.

The lawyer continued: “Her husband continues to reside with her and he is in court with her today.

“She takes medication which should only be taken when alcohol use is restricted.”

The court was also told that Malloy is currently subject to a CPO which she engages well with.

Sheriff Christopher Shead sentenced Malloy to 18 months of supervision and 60 hours of unpaid work.
