AN ALVA man has been handed a four-month jail term after “exhausting all opportunities” to remain within the community.

John Watt (31) appeared at Alloa Sheriff Court last Thursday (20 August) on one charge of threatening behaviour and another for threatening to brick the local police station.

However, the court took the view that he had been ignoring a previous community payback order and therefore only custody would do.

Watt admitted that on 24 April 2015, at a property on Quarry Place, Sauchie, he did shout, swear and utter threats of violence.

Court papers also show that this offence formed a breach of an undertaking to appear at Alloa Sheriff Court in May.

Then on 13 June 2015, Watt attended the police station in Alloa and threatened to smash the window as he wanted to be taken to Stirling Police Station.

Depute fiscal Iain Batho told the court: “At 4am, police officers returned to Alloa Police Office and observed the accused around the back of the building.

“When asked what he was doing there, he said: ‘I want to go to Randolphfield’.” After Watt threatened to smash the window, he left the area before returning with two stones and repeating the threat.

Mr Batho added: “Officers then removed the stones from his hands and he was cautioned and charged.” The court heard that Watt had been failing to comply with a drug treatment and testing order, but his defence agent Kelly Howe urged the court to consider giving him a final chance to honour his commitment.

However, Sheriff David Mackie responded by expressing his “doubts” over such a disposal.

He told Watt: “I’ve been invited to give you a further opportunity but that’s not going to happen today.

“You are simply not engaging with a previous order and I’m afraid the court has lost confidence in your ability to deal with this in the community.

“You’ve exhausted all opportunities available to you and so I will impose a custodial sentence.” The sheriff told Watt he would serve three months for the first offence and four months for police station incident.

Both sentences will run concurrently and so Watt is likely to be released in the middle of October.
