AN ALLOA man who cut a friend's face with a pen knife was sentenced to 200 hours community service at the town's sheriff court on Thursday.
Andrew Sprengel (22), of Mar Place, appeared for sentence after previously admitting the assault on 26 March at Westview Crescent in Tullibody, scratching his victim to the face with a pen knife whilst on bail.
Fiscal depute Jim Graham told the court that the victim, Sprengel and others went to the house in Tullibody and consumed alcohol with Sprengel drinking Buckfast and taking valium.
Sprengel, his girlfriend and the victim then walked to Sprengel's mother's house and she heard them arrive.
Then at 10pm Sprengel's mother, who was in bed, heard her son and his girlfriend leave the house.
She then found the victim, who wasn't known to her, asleep on the bed and when Sprengel returned with his girlfriend he shook the victim awake and took a pen knife and cut his victim on the left hand side of the face after his girlfriend alleged that she had been indecently assaulted by him.
Sprengel's mother heard the commotion and went into the bedroom and she and Sprengel's girlfriend pulled him away from the victim. The 22-year-old's mother then cleaned up the victims face and took him back to Tarragon House.
Sprengel's defence solicitor said that his client was fortunate that the injury to his victim wasn't serious and that there wasn't any permanent scarring although Sprengel was aware that Sheriff Mackie would be considering a custodial sentence.
Sheriff Mackie told Sprengel that the offence merited a custodial sentence. However, he decided he would impose a community service order as a direct alternative to allow him to make progress on his current probation order.
