A CONVICTED sex offender has been hauled before a judge this week charged with breaking the conditions of a court protection order.

In August 2007, the 65-year-old was placed under the terms of a Sexual Offences Protection Order (SOPO) which prohibits him from making contact with certain individuals.

Yet, it is alleged that between 3-10 April, 2014, he did repeatedly breach the order while within HMP Glenochil.

The accused appeared at Alloa Sheriff Court on Monday (22 June) and maintained his plea of not guilty.

A trial date has been set for 15 July, with a further intermediate diet to be heard on 6 July.

AN ALVA man is to be sentenced next month after entering another man’s home and challenging him while in possession of a knife.

Steven Duncan (46), of The Wynd, pleaded guilty to the charge when he appeared at Alloa Sheriff Court on Monday (22 June).

He had gone to a property in Southcroft, Alva, to challenge the occupant over an earlier altercation between the two.

The court heard that Duncan was heard shouting for the complainer and had entered his home uninvited.

Depute fiscal Denise Bruce said: “The complainer told the accused he had no right to come into his house and asked him to leave.

“He saw the accused had a knife tucked up his sleeve.

“The two then agreed to go outside where the accused punched the complainer on the head and a fight ensued...police then arrived at around 4.15pm and the accused was detained.” In reply to being cautioned and charged, Duncan said: “I did do that, I’m sorry. I should’ve dealt with it differently.” The court papers state that on 2 May 2015 Duncan did behave in a threatening and abusive manner and did enter a dwelling house uninvited, shout, swear, act in an aggressive manner whilst in possession of a knife, and engage in a fight.

Sheriff Christopher Shead, presiding, then called for criminal justice social work reports before handing out his sentence.

Duncan will re-appear at Alloa Sheriff Court on 23 July.

AN ALLOA man will finally go to trial next month on knife charges stretching back more than 18 months.

It is also alleged he assaulted a woman by presenting a knife at her during the same incident.

He has already admitted two breaches of community payback orders and his sentences are being deferred until after the trial.

A GLENOCHIL inmate has denied threatening to hand out pictures of women’s child to a “specific group of offenders” within the Clacks prison.

On 31 July, the 28-year-old is alleged to have repeatedly made numerous calls from custody which were grossly offensive, or of an indecent, obscene or menacing nature.

He is accused of acting in an aggressive manner, swearing, making remarks of a degrading nature and utter threats to distribute photographs of the woman’s child to what is thought to be the prison’s large population of sex offenders.

He is accused of assaulting the man at a property on Newmills, Tullibody, on 24 April last year, when he demanded his possessions before brandishing a knife and “striking him on the hand” with the blade.

The court papers allege this assault was carried with intent to rob his victim.

The teen, from Sauchie, denied the charge and a trial has been scheduled for 17 July with a further intermediate diet set down for 6 July.

A GLENOCHIL inmate has admitted a charge of possessing a mobile phone this week.

James Wilson (44) represented himself during a pleading diet at Alloa Sheriff Court on Monday (22 June).

It was heard that guards at the Clacks prison recovered the contraband during a routine inspection of Wilson’s cell on 2 March of this year.

The accused then told the court: “I am guilty of the crime. I was caught with the phone and have been punished in prison.” He informed Sheriff Christopher Shead that he had spent 17 years in prison.

Wilson said he had been on release for three years when he was recalled on a drugs charge which was subsequently dropped.

The court heard the inmate has a parole hearing set for August of this year.

Sheriff Shead then imposed a sentence of four months, reduced from six due to his early plea.

As he was being led away, Wilson uttered to the bench: “Nice one.”
