A SAUCHIE man has been handed unpaid work for his part in a “rammy” outside the Star Inn shortly before Christmas last year.

Stefan Hoggan (21) had been out with his brother and friends before getting into a scrap with the complainer, Lee McCue, on 23 December.

The incident took place just outside the Drysdale Street pub at 10.20pm and was caught on CCTV.

Hoggan, of Mar Place, appeared at Alloa Sheriff Court on Monday (10 August) where he admitted kicking a man on the head while he was on the ground.

Depute fiscal Ann Orr said police were called out with regards to an “ongoing fight” outside the Star Inn.

She said: “It appears Mr McCue assaulted Mr Hoggan by striking him. Another person then punched Mr McCue a number of times.

“Mr McCue then fell to the ground ... at this time, Mr Hoggan then approached him and kicked him on the head.” Hoggan, who is a first offender, admitted to the charge after the court accepted there had been an element of provocation on the part of the complainer.

His solicitor, Kelly Howe, said: “Mr Hoggan acted in the manner libelled while in an angered and heightened state. He realises that a kick to the head is a serious incident.” The court heard that McCue was offered a fiscal fine in relation to his role, while no action was taken against the man who first punched him, causing him to fall to the ground.

Sheriff Gillian Wade then told Hoggan to carry out 50 hours of unpaid work, reduced heavily to reflect his early plea and the fact he was provoked.

She said: “I do accept there was an element of provocation here but a kick to the head is a serious matter.

“I appreciate you were part of a rammy which involved other people but your role in this must be marked by an appropriate sentence.”
