A WEE COUNTY man who threatened to set his former partner on fire has had his sentence deferred for three months.

Graham Henderson appeared at Alloa Sheriff Court on Monday, March 26, after pleading guilty to an amended charge of behaving in a threatening or abusive manner and causing fear or alarm.

Prosecutor Susan Campbell said that Henderson had previously been in a relationship with the complainer and they had a daughter together.

She added: “On January 29 at 8pm, the complainer was getting texts from the accused about their daughter. She was reluctant to grant access and an argument ensued.”

The accused phoned the complainer and said: “I’ll just come down to Sauchie and set you all on fire.”

He then proceeded to send further text messages, one of which said that if he does not get to see his daughter, then the complainer’s new partner will be “getting it”.

Police were then contacted and Henderson was arrested, to which he responded: “I did not say that”.

Claire McCarron, defending Henderson of James Pollock Court, Tillicoultry, told the court that the pair had “many disagreements in the past regarding her [their daughter]”.

She added that the 30-year-old had taken Valium on the night in question and had little recollection of any of it.

Ms McCarron also described the phone call as a “pathetic attempt to threaten her”, adding that after that threat, the pair were “as bad as each other” on the phone call which was recorded.

Henderson, who is already on two community payback orders, had his sentence deferred for three months while reports are prepared.
