A TILLY man caught drink-driving and without a full license has been fined and disqualified for 12 months.

Christopher Timline, of Church Grove, admitted being over the limit when he was stopped by police on 25 July this year.

He also pleaded guilty to driving without insurance and under a provisional license without accompaniment and without displaying “L” plates on the vehicle.

The 21-year-old appeared at Alloa Sheriff Court on Thursday (20 August) for sentencing.

Depute fiscal Iain Batho said that at around 1.10am “police officers on patrol had their attention drawn to the accused’s vehicle”.

The accused then stopped the vehicle and made off on foot before officers traced him nearby.

They “noted a strong smell of alcohol” on him and requested he take a roadside breath test, which he failed.

The court papers say that Timline did drive the vehicle with a reading of 35mg of alcohol per 100ml of breath — above the 22mg limit.

Claire McCarron, defending, said her client had been working his way to completing his driving test and had bought a car for when he had done so.

He planned to leave the car at his partner’s house until then and was at that address on the night in question.

Ms McCarron added that Timline and his partner had consumed a bottle of wine between them before the accused received a phone call from his sister.

She said: “She was quite hysterical and he thought he had to go to her assistance.

“He was aware that he shouldn’t have been driving and when the police spoke to him he was fully compliant.

“Mr Timline did not appreciate he was over the limit.” In sentencing, Sheriff David Mackie said that the 21-year-old would benefit from understanding the effects of alcohol.

He ordered that he pay a total of £510 in fines and that he be disqualified from holding or obtaining a license for the next 12 months.

However, should he complete the drink-driver’s rehabilitation course, the sheriff informed him that his period of disqualification would be reduced to nine months.
