AN ALLOA man has been given a curfew and ordered to pay compensation after leaving a man permanently disfigured following a brutal assault.

Alan Walsh originally appeared on petition for the assault which he pleaded guilty to when it was reduced to a summary matter.

He reappeared at Alloa Sheriff Court on Thursday, February 7, for sentencing where Susannah Hutchison, depute fiscal, described the sickening assault which took place in Alloa’s Star Inn pub on March 25 of last year.

At around 11.45pm the complainer and his partner arrived at the bar on Drysdale Street.

At around 2am they were leaving when they were “encountered” by the accused who made a comment which the complainer answered back to.

Walsh was then seen punching the complainer on the head, causing him to fall to the ground in a heap.

The accused then made off as staff went to the doorway where it happened to check on the victim.

He was seen to be bleeding heavily from a head wound and appeared heavily intoxicated, according to Ms Hutchison, who added that he was taken to hospital as police began scouring CCTV.

The complainer suffered a two-inch laceration above one of his eyes and required around seven or eight stitches.

The accused made no reply to caution or charge when arrested by police.

Kelly Howe, representing the 40-year-old, said her client has recent record but no offence since 2012 and nothing outstanding.

She added that Walsh recognises the seriousness of the offence, adding that the pair did not know each other so there was no prior bad blood.

Describing the lead up to the assault, Ms Howe said her client claimed the complainer had been verbally abusive towards him, and CCTV, which was checked by Ms Howe’s office, showed the complainer repeatedly say something to the accused while smoking.

Nonetheless, the accused, who was described as a “working man”, was “genuinely remorseful”.

Sheriff David Mackie imposed a curfew on Walsh, of Sunnyside Court, Alloa, stopping him from leaving his home between the hours of 8pm and 5am for three months.

He was also ordered to pay the victim £500.
