A MAN who sexually assaulted a sleeping woman by pulling her trousers down and molesting her has had his name added to the sex offenders’ register for five years.

John Tams committed the offence at an address in Clacks on February 10, 2018, and was sentenced at Alloa Sheriff Court on Thursday, February 13.

The 38-year-old’s solicitor, Kelly Howe, claimed backgrounds reports showed he had “difficulties in relation to understanding of intimacy and boundaries”.

But she also claimed they suggested he didn’t pose any “significant issues in terms of serious harm or public protection”.

Sheriff Simon Collins QC claimed he viewed the offence as a “serious matter”.

He said: “I’ve indicated the first consideration for the court is whether a custodial sentence should be imposed.

“I have read the reports, and I’m satisfied, just, that there’s an alternative to custody here.”

He then imposed a curfew on Tams, requiring him to wear an electronic tag and remain within his home on Lochbrae between 7pm and 7am for four months.

He will also be required to undergo supervision for 12 months.
