A CLACKMANNAN man with a lengthy criminal record has been jailed over a racist incident where he threatened a shop worker.

The victim was working in the family shop and asked for James Daniels to pay an outstanding bill.

This brought an angry response with Daniels who then threatened to punch him.

The42-year-old, also known as Thomas Page, appeared in the dock at Alloa Sheriff Court.

He admitted that on March 19, last year, at A&T Foodstore, Lochies Road, Clackmannan, he acted in a racially aggravated manner to a shop worker, acted aggressively, shouted, swore, made a threat of violence and a racial remark.

Depute fiscal Rachel Wallace said Daniels, of Zetland Street, had claimed he had no money when asked to pay his bill.

He then became angry saying: "I'll punch you over the f****** counter. Don't be cheeky to me again, you dirty black b******".

The court was told Daniels' position was he claimed a racist comment was made to him which triggered the incident.

After considering the facts of the case, Sheriff Neil Bowie jailed Daniels for 100 days.
